PAGA notice

A PAGA notice is the written notice an employee must file with the California Labor and Workforce Development Agency, and send to the employer, before suing under the Private Attorneys General Act. It has to name the sections of the Labor Code the employee says were violated, with the facts and theories behind each.

The Act is the Labor Code Private Attorneys General Act of 2004, enacted in 2003 and in effect since 1 January 2004, at Labor Code section 2698 and following. The Act itself calls it written notice; PAGA notice is the name the LWDA uses, as in its PAGA frequently asked questions at labor.ca.gov.
